Here's how I think we stop the US government from banning abortions, gender-affirming care, HRT, etc. Starting in Florida:

Fla. Stat. § 458.327, 1, a

This statute makes it a 3RD DEGREE FELONY to practice medicine without a license.

By saying that a medial procedure is unneeded, not advised, or inappropriate for a patient, the Florida state legislature and governor are practicing medicine without a license.

We need someone to sue, and to win.

Then we duplicate this in every State.

By the way ... this might work on insurance companies as well, when they deny payment by saying a procedure or drug "isn't necessary".

This idea definitely lifted my spirits, thanks. I've started at least five posts today and deleted every one. I think I've reached my limit on the insanity in Florida and Texas and all the other states run by Nazi madmen.

As for DeSantis, he should pay for his sins by spending the rest of his life at Disney World in a Disney character costume, wandering around claiming to be the Governor of Florida while people laugh and call him Goofy.

Is there a #lawyer who could offer an opinion on this? Non binding and unofficial opinion of course .

@drmaddkap law is meaningless to conservatives for whom they believe that law is designed to protect their in-group and not bind, but to bind the out-group and not protect.

Great example would be the "don't say gay" laws propagating across the states. Many of them draw the line at any mention of gender in a relationship. Do you truthfully feel that this legal harassment will be equally geared towards straight teachers as it would for those in a homosexual/lesbian relationship?

Also like, we also have to take into consideration that laws need enforcement. And who are we to place our trust in the police force, nevermind a single cop?

@drmaddkap I'm not very confident about this suggestion because of the Speech and Debate clause of the US Constitution, which reads in part:

> [The Senators and Representatives] shall in all cases, except treason, felony and breach of the peace, be privileged from arrest [...] for any speech or debate in either House, they shall not be questioned in any other place.

This has created a doctrine of "legislative immunity" which holds that they can't be prosecuted for writing laws.

Interesting idea of fighting political #fascism of #RDS in #FL:

Does it have legal merit?
